Terms of use
The rules for using Tapwah, in plain language.
Please read these terms carefully. They include a binding arbitration agreement and a class action waiver (see “Disputes and arbitration”) that affect how disputes are resolved, unless you opt out within 30 days. They also limit our liability.
The basics
These terms are an agreement between you and Tapwah (“Tapwah”, “we”, “us”). They cover tapwah.com, app.tapwah.com and everything you do there (together, “Tapwah” or the “service”). Our acceptable use policy is part of these terms. Our privacy policy explains how we handle personal data.
By creating an account, signing in or using Tapwah, you agree to these terms. If you don’t agree, don’t use Tapwah.
Who can use Tapwah
- You must be at least 16 years old. If you are under 18, or under the age of majority where you live, a parent or legal guardian must agree to these terms for you, and they are responsible for your use of Tapwah.
- You may not use Tapwah if the law, including US sanctions and export rules, does not allow you to, or if we have closed an account of yours before.
- If you use Tapwah for a company or other organization, you confirm that you can accept these terms for it, and “you” includes that organization.
Your account
You sign in with a one-time code sent to your email address or with Google. Give us accurate information and keep access to your email and Google accounts safe. One free account per person. You are responsible for everything done through your account. Tell us at hello@tapwah.com right away if you think someone else has used it.
What Tapwah does
Tapwah lets you describe an iPhone app in a chat. An AI agent writes the app’s code, and we build it and run it on an iOS simulator on Macs we operate, shown live in your browser. Your app can store data, files and its own user accounts in a backend that Tapwah runs. Tapwah is a new service. Features, limits and availability will change.
Your content and your app
“Your content” means your messages, the ideas and files you give us, and the code and app that Tapwah writes for you. As between you and us, you own your content. We don’t claim ownership of your app.
You give Tapwah a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, build, run, display to you and adapt your content, and to share it with the providers that help us run Tapwah, only as needed to provide, secure and support Tapwah and to enforce these terms. This license ends when your content is deleted from Tapwah, except for copies kept in backups and logs for the limited time described in our privacy policy.
You confirm that you have the rights you need in your content, and that your content and your use of it don’t break the law or anyone else’s rights.
Tapwah adds some of its own code to every app, such as the starter project and the client for Tapwah’s backend. We give you a non-exclusive, royalty-free license to use, copy and change that code as part of your app.
Your app’s users and their data
If your app collects data from other people, such as accounts or records stored in Tapwah’s backend, you decide what it collects and you are responsible for it. We store that data on your behalf. You must have a lawful basis for it, tell those people how it is used (for example, in your own privacy policy) and follow the laws that apply to you. Don’t use Tapwah’s backend to store payment card numbers, government ID numbers, health records, passwords for other services, or data about children under 13.
AI-generated output
Tapwah uses AI (Claude, made by Anthropic) to write code and answer you. AI output can be wrong, incomplete, insecure, or similar to output given to other people, and it may not do what you asked. You are responsible for reviewing and testing your app before you rely on it, share it or publish it, including making sure it follows Apple’s rules, the laws that apply to it and other people’s rights, such as copyrights, trademarks and privacy. Output is not legal, financial, medical or other professional advice. We don’t promise that any output is original or that you can register or protect it.
How we use data to run and improve Tapwah
We may use aggregated or de-identified data about how Tapwah is used, such as numbers of builds, time spent and AI cost, to run, secure and improve Tapwah. That data does not identify you. We don’t sell your content and we don’t use it to train AI models. We may look at an account’s content when it is needed to give you support you ask for, to fix a problem, to investigate abuse or a security issue, or when the law requires it.
Feedback
If you send us ideas, suggestions or other feedback, we may use them for any purpose, without paying you or owing you anything.
Plans, limits and pricing
Tapwah is free to start. The free plan has daily limits on building time and AI work, which reset at 00:00 UTC (see pricing). We may change, lower or remove any plan, limit or free feature at any time. A running message may finish after you reach a limit; we don’t promise any minimum amount of building time or AI work. Paid plans are not on sale yet. When they are, they will come with their own pricing and payment terms, which you will see and accept before you pay.
Rules for using Tapwah
Follow the acceptable use policy. Unless we agree in writing, you may not:
- copy, sell, resell, rent or sublicense Tapwah or access to it, or offer it as part of another service;
- access Tapwah with bots, scripts, scrapers or other automated means, except through the browser pages we provide, or collect data from it;
- reverse engineer, decompile or try to get the source code of Tapwah, or get around its sandbox, limits, security or access controls;
- use Tapwah to build a competing service, or to benchmark it for publication without our permission;
- remove or hide notices about ownership or rights.
Tapwah, including its software, design, prompts, templates and brand, belongs to us and our licensors. Apart from the licenses in these terms, you get no rights in it.
Other companies’ services
Tapwah depends on services from other companies, including Apple (iOS, Xcode and the App Store), Anthropic (the AI model), Supabase (accounts and data), Cloudflare (hosting, network and video), Google (if you sign in with Google) and Mailfully (sign-in emails). Their own terms and policies apply to their services, and we are not responsible for them. If one of them changes or stops a service, we may have to change or stop part of Tapwah.
Publishing to the App Store
To publish an app on Apple’s App Store you need your own Apple Developer Program membership, and you must follow Apple’s agreements and App Store Review Guidelines. Apple decides whether to approve, keep or remove an app. We don’t promise that your app will be approved. You are the developer and publisher of your app and are responsible for it, including its listing, privacy disclosures and support. Tapwah is not affiliated with or endorsed by Apple.
Changes to Tapwah and to these terms
We may change, add or remove features, limits and parts of Tapwah, or stop offering Tapwah, at any time, with or without notice. We may change these terms. We’ll post the new terms on this page and update the date at the top, and if a change is material we’ll make reasonable efforts to tell you, for example by email or in the app. Changes take effect when posted, unless we say otherwise. If you keep using Tapwah after a change takes effect, you accept the new terms. If you don’t, stop using Tapwah and delete your account. A change to “Disputes and arbitration” does not apply to a dispute we already knew about before the change.
Suspension and ending
You can stop using Tapwah and delete your account at any time from the account page.
We may suspend, limit or close your account, end any session, or remove any content, at any time and at our discretion, with or without notice, including if we believe you broke these terms or the acceptable use policy, if your use creates risk or possible legal exposure for us, other users or anyone else, if we must by law, or if we stop offering Tapwah. Where we think it is appropriate and allowed, we’ll tell you why.
When your account ends, your right to use Tapwah ends, and we delete your data as described in our privacy policy. Deleted data can’t be recovered. The sections that by their nature should continue (including your content license for backups, feedback, AI output, no guarantees, limitation of liability, indemnity, disputes and arbitration, governing law and the general terms) continue after your account ends.
Keep your own copies
We don’t promise to keep your content, and you are responsible for keeping your own copies of anything important. Data your app saves on the simulator is erased between sessions. Your code, chat history and backend data can be lost, for example through an error, an outage or a change to Tapwah, and we are not responsible for that loss.
No guarantees
TAPWAH, ITS AI OUTPUT AND EVERYTHING ELSE WE PROVIDE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING ANY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND QUIET ENJOYMENT, AND ANY ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT PROMISE THAT TAPWAH WILL BE AVAILABLE, UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, THAT IT WILL MEET YOUR NEEDS, THAT ANY APP OR OUTPUT WILL WORK OR BE ACCURATE, OR THAT YOUR CONTENT OR DATA WILL BE KEPT OR NOT LOST.
Some places don’t allow some of these exclusions, so some of them may not apply to you. If you are a consumer, you may have rights under your local law that these terms can’t change.
Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS: (A) TAPWAH AND ITS OWNERS, EMPLOYEES, CONTRACTORS, PROVIDERS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA OR CONTENT, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO TAPWAH OR THESE TERMS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO TAPWAH OR THESE TERMS WILL NOT BE MORE THAN THE GREATER OF THE AMOUNT YOU PAID US FOR TAPWAH IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM, OR US$50.
These limits apply whatever the legal theory (contract, tort including negligence, statute or otherwise), and even if a remedy fails of its essential purpose. They do not limit liability that the law does not allow to be limited, such as liability for death or personal injury caused by negligence, or for fraud.
Indemnity
To the extent the law allows, you will defend, indemnify and hold harmless Tapwah and its owners, employees, contractors, providers and licensors from any claims, losses, damages, fines and costs (including reasonable lawyers’ fees) arising out of or relating to your content, your app (including its data and its users), your use of Tapwah, or your breach of these terms or the law. We may take control of the defense of a claim, and you will cooperate with us. You may not settle a claim that affects us without our written consent.
Disputes and arbitration
Please read this section carefully. It requires you and Tapwah to resolve most disputes by binding individual arbitration and not in court, and it waives your right to a jury trial and to bring or join a class action.
Try to resolve it first. Before starting a claim, email hello@tapwah.com with your name, your account email, a description of the dispute and what you want. We’ll try to resolve it informally. If it isn’t resolved within 60 days, either of us may start arbitration.
Arbitration. Any dispute, claim or controversy between you and Tapwah arising out of or relating to Tapwah or these terms (including whether this arbitration agreement applies or is enforceable) will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator. The Federal Arbitration Act governs this section. Arbitration may take place by video, phone or written submissions, or in person in the US county where you live or another place we agree. Fees are paid as the AAA rules require. The arbitrator may award the same individual relief a court could, but only to you or us individually.
Exceptions. Either of us may bring an individual claim in small claims court if it qualifies. Either of us may also ask a court for an injunction or other equitable relief to stop the infringement or misuse of intellectual property or of the service.
Class action waiver. You and Tapwah may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective, consolidated or representative action. The arbitrator may not combine more than one person’s claims. If this waiver is found unenforceable for a claim, that claim will be decided in court, not in arbitration, and the rest of this section still applies. If 25 or more similar arbitration demands are filed by or with the help of the same lawyers or organization, the AAA may administer them in batches, and the parties will cooperate on that.
30-day opt-out. You can opt out of this arbitration agreement by emailing hello@tapwah.com with the subject “Arbitration opt-out”, your name and your account email, within 30 days of first accepting these terms. Opting out doesn’t affect the rest of these terms.
Time limit. To the extent the law allows, any claim must be started within one year after it arose, or it is permanently barred.
If you live in the EU, the UK or another place whose law does not allow this section to bind consumers, it does not apply to you, and you may bring a claim in the courts where you live.
Governing law and courts
These terms and any dispute between you and Tapwah are governed by the laws of the State of Delaware, USA, and applicable US federal law, without regard to conflict of laws rules. The UN Convention on Contracts for the International Sale of Goods does not apply. Any dispute that is not arbitrated will be heard only in the state or federal courts located in Delaware, and you and Tapwah agree to their jurisdiction. If you are a consumer in the EU or the UK, you also keep the protection of the mandatory laws of the country where you live and may bring a claim in its courts.
General
- Entire agreement. These terms, with the acceptable use policy and any terms we show you for a specific feature or paid plan, are the whole agreement between you and Tapwah about the service and replace any earlier agreement about it.
- Severability. If any part of these terms is found unenforceable, it will be enforced as far as possible, and the rest stays in effect.
- No waiver. If we don’t enforce a part of these terms, that doesn’t mean we give up the right to enforce it later.
- Assignment. You may not transfer these terms or your account without our written consent. We may transfer them, for example as part of a merger, acquisition or sale of assets.
- Things outside our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages or changes at our providers, internet or power failures, attacks, natural disasters, war, labor disputes or government action.
- Notices. We may send you notices by email to your account address, in the app or by posting them on tapwah.com. Send notices to us at hello@tapwah.com.
- Relationship. These terms don’t create a partnership, employment or agency relationship, and they give no rights to anyone else.
- Language. These terms are written in English. If a translation differs, the English version controls, unless local law says otherwise.
